The 1st Competition Law Salon: Anti-Unfair Competition Law (Revised Draft) Seminar

On March 18th, 2017, the 1st Competition Law Salon: Anti-Unfair Competition Law (Revised Draft) Seminar was held in Mingde Law Building. It was sponsored by Renmin Law School, Ministry of Industry and Information Technology Electronic Intellectual Property Center, Beijing Economic Law Society, and it was organized by Tencent Research Center and Caompetition Policy Research magazine.

Coinciding with the National Peoples Congress Legislative Affairs Commission seeking for public comments on Anti-Unfair Competition Law (Revised Draft), the 1st competition law salon invited SUN Xianzhong, researcher of Chinese Academy of Social Sciences and NPC representative, WANG Xiaoye, researcher of Chinese Academy of Social Sciences, Professor KONG Xiangjun at Shanghai Jiao Tong University Koguan School of Law, Professor WANG Xianlin at Shanghai Jiao Tong University Koguan School of Law, Professor SHENG Jiemin at Peking University Law School, Professor HUANG Yong at University of International Business and Economics School of Law, Professor YU Li at Tianjin University of Finance and Economics, Professor ZHENG Youde at Huazhong University of Science and Technology, Professor HAN Dayuan at Renmin Law School, Associate Professor ZHANG Guangliang at Renmin Law School, Associate Professor YAO Haifang at Renmin Law School, Associate Professor DAI Long at China University of Political Science and Law, Associate Professor YANG Huaquan at Beijing Institute of Technology, and experts from NPC Legislative Affairs Commission, State Administration for Industry & Commerce, Ministry of Industry and Information Technology Electronic Intellectual Property Center. Attendees had a interdisciplinary discussion over the draft, and proposed concrete comments. Professor MENG Yanbei at Renmin Law School chaired the seminar.

A series of anti-unfair competition law theoretic issues were discussed in details: is the anti-unfair competition law a private law or a public law? What is its future trend? Is the anti-unfair competition law irrelevant to the competition policy? Should its legislative aim be directly protecting the rights and interests of consumers? On such basis, the draft was reviewed article by article, forming systematic comments and suggestions.
