The 2nd Competition Law Salon: Anti-monopoly Guide on Abuses of Intellectual Property (Consultation Paper) Seminar

On April 20th, 2017, the 2nd Competition Law Salon: Anti-monopoly Guide on Abuses of Intellectual Property (Consultation Paper) Seminar was held in Mingde Law Building. It was organized by Renmin Law School, Ministry of Industry and Information Technology Electronic Intellectual Property Center, Beijing Economic Law Society, and co-organized by Tencent Research Institute and Competition Policy Research Magazine.

Coinciding with the State Council Anti-monopoly Commission seeking for public comments on Anti-monopoly Guide on Abuses of Intellectual Property (Consultation Paper), the 2nd competition law salon invited WANG Xiaoye, Researcher of Chinese Academy of Social Sciences, Professor SHI Jianzhong, vice president of China University of Political Science and Law, Professor HUANG Yong at University of International Business and Economics School of Law, Professor XU Guangyao at Nankai University School of Law, Professor HAN Liyu at Renmin Law School, DONG Dudu, Post Doctor at Renmin University School of Economics, Doctor YAO Qi at Beijing Foreign Studies University, experts from the Bureau of Price Supervision and Anti-Monopoly of National Development and Reform Commission, State Intellectual Property Office Department of Treaty and Law, Ministry of Commerce Anti-monopoly Bureau, China Academy of Information and Communications Technology, Ministry of Industry and Information Technology Electronic Intellectual Property Center, and representatives from Tencent, ZTE, China Mobile, Lenovo, Intel, East & Concord Partners, Zhong Lun Law Firm, DHH Law Firm. Attendees had an in-depth discussion on the paper. LI Huiying, the vice director of Electronic Intellectual Property Center gave an opening speech. Professor MENG Yanbei and Professor HUANG Yong co-chaired the seminar. Professor SHI Jianzhong gave a concluding speech.

This seminar comprised two parts. After experts involved in the formulation of the guide introducing its development, identification, characteristics and contents, the attendees discussed the consultation paper article by article, especially the framework design, how to combine anti-monopoly analysis with the particularity of intellectual property, the application of essential facility doctrine, no-challenge clause, refusal to license intellectual property rights clause, injunctive relief clause and the copyright collective management organization clause.
