The second seminar for the operation project “ the internet regulatory paradigm in EU and China” between RUC and Ludwig-Maximilians-Universität München was held successfully

From 2nd to 5th in September, the second seminar for the operation project “ the internet regulatory paradigm in EU and China” between RUC and Ludwig-Maximilians-Universität München was held successfully. A group was set up by both school, which of our school consisted of Yu Wenguang, Chen Xuan, Ding Xiaodong, Xiong Bingwan and Tian Wei. And Germany team was constituted by Christoph KrönkeMichael MüllerLaura MünklerWalther Michl and Daniel Wolff.

The cooperation project aimed at internet regulation, a problem both meaningful in Chinese and Germany theory and practice, hoping to seek balance and innovation between excessive and inadequate regulation, government and self-regulation, by comparison among system in EU, China and German. A seminar was held in Beijing in April.

Professor Christian Walter, Head of International Exchange and Cooperation of LMU law school, attended the meeting, where he spoke highly of the significance of the study, and showed his hope for high quality results. Professor Walter also gave a speech entitled “Cyber Security as a Challenge for Public International Law".

During the three-day seminar, two teams gave reports on Fundamental Rights in the Digital Era, Horizontal Effect and the Distinction between State and Society, Space as a Paradigm of Internet Regulation, Self-Regulation in the Shadow of Public Power, Digital Border Control, Boundary of Criminal Regulation in Cyberspace, What Is Data Privacy? A Comparative View, Internet Security in Times of International Terrorism. Doctor Sandra Wachter from University of Oxford was also invited to give a speech “The Ethics of Big Data, AI and Robotics”, in which he analysed the issue whether there is right to explanation in large data and artificial intelligence, and robotics. And a holistic approach was proposed by him.

During the meeting, team members visited Bayerischer Verwaltungsgerichtshof, and had a talk with Doctor Erwin Allesch, Vice-President of the Higher Administrative Court, and Judge Sabine Lotz-Schimmelpfennig, Chairman of the Association of Judges of the Bavarian State Court of Justice.

On the basis of the two meetings, the cooperation project is expected to publish the research result in English periodical next year. The heads of two teams were also invited to attend the third LMU - ChAN Scientific Forum on 28th October, and gave theme report on the forum.

During the project, team members recognised the importance of international cooperation and comparative research in internet regulation, and hope to response to the global challenge to traditional legal system brought by the internet by deeper cooperation in the future.
