Seminar on Rule of Law in China: its Theoretical Logic and Practical Value and the 25th Anniversary of Center for Legal Post Doctoral Studies

On October 21st, 2017, ¡°Rule of Law in China: its Theoretical Logic and Practical Value¡± seminar and the 25th anniversary of center for legal post doctoral studies was held in the Century Hall, Renmin University of China (RUC).

Grand Justice Hu Yunteng, who was a member of the Supreme People¡¯s Court judicial committee (vice-minister level) and the president of the Second Circuit Court, Grand Procurator Chen Guoqing, who was a member of the Supreme People¡¯s Procuratorate procuratorial committee (vice-minister level), Professor Wang Liming, the executive vice president of RUC, Professor Cheng Tianquan, the former party secretary of RUC, Professor Zhang Zhihui, the director of the Procuratorial Theory Institute of the Supreme People¡¯s Procuratorate, Professor Shi Shaoxia, the dean and the former party secretary of National Procurator¡¯s College, Professor Yang Yingze, the vice dean of National Procurator¡¯s College, Professor Guo Honglin, the assistant to the president and division chief of the personnel department of RUC, Liu Danhua, the vice party secretary of the China Post Doctor Science Foundation, and Piao Wendan, the vice party secretary of the Peking University Law School, attended the seminar. Dean Wang Yi, Vice Dean Lin Jia, Vice Dean Yang Dong, Vice Dean Du Huanfang, Vice Dean Zhang Xiang, Professor Ye Qiuhua, Professor Ma Xiaohong, Professor Liu Mingxiang, Professor Xie Wangyuan, Professor Guo He, Professor Tang Weijian, Professor Zhao Xiuwen, and nearly 100 postdoctoral researchers participated in the seminar.

Professor Lin Jia, the party secretary and vice dean of Renmin Law School, presided over the opening ceremony of the event. Lin firstly expressed sincere welcome to all attendees, and pointed out that this October saw the 19th National Congress of the CPC, and the 80th Anniversary of Renmin University of China. In such a grand day, the center for legal post doctoral studies had its 25th anniversary. We came together to discuss the theory and practice of the rule of law, and to celebrate the birthday of the center.



The attendees watched the promo video of 25th Anniversary of the center for legal post doctoral studies, reviewing its main achievements in the past 25 years. The center was the earliest among all legal post doctoral centers established in China. The center covered eleven doctor¡¯s degree grants, and contained a wide range of disciplines. In three national evaluations, the center had been awarded as an excellent center. In 25 years, the postdoctoral team had published nearly 1000 papers and 248 books. Up to now, 220 post doctoral researchers had worked in the center. 35 worked currently in the center.

Professor Wang Liming, the executive vice president of RUC, delivered a speech in the opening ceremony. Wang stressed that, as a Renmin alumi, every post doctor shall bear the passion for the country in mind and carry out ¡°seek truth from facts¡± motto in the study. He pointed out that the 19th National Congress of the CPC put forward the overall guideline for the next five years, which was closely related to the process of the rule of law in China. Every jurist shall take the law as his or her own belief, and undertake the important task of building the rule of law in China.


Grand Justice Hu Yunteng, who was a member of the Supreme People¡¯s Court judicial committee (vice-minister level) and the president of the Second Circuit Court, said the center was the earliest established in China, and was an important part of scholar training for Renmin Law School. Hu introduced that the Supreme People¡¯s court had attached great importance to the cooperation with Renmin Law School, and encouraged post doctors to understand the legal practice in depth.


Grand Procurator Chen Guoqing, who was a member of the Supreme People¡¯s Procuratorate procuratorial committee (vice-minister level), introduced the post doctors joint-training project between Renmin Law School and the Supreme People¡¯s Procuratorate. Chen also raised his expectations for the center: to continue the study of socialist rule of law theory with Chinese characteristics, to deepen the combination of theory and practice, to keep the new technologies in focus, to deepen the cross disciplinary research, and to attach great importance to the ideological and moral education of law talents.


Professor Cheng Tianquan, the former party secretary of RUC, talked about the relevance of the center¡¯s fruitful achievements in the past 25 years and the great course of the rule of law in china. Cheng stressed that post doctors should combine theory and practice deeply to make creative achievements, and should always remember the identity as a post doctor of Renmin Law School to make greater achievements.


Liu Danhua, the vice party secretary of the China Post Doctor Science Foundation, highly praised that the center did a great job in personnel training, institutional construction and management service, and put forward some expectations for its development.


On behalf of Renmin Law School, Dean Wang Yi welcomed postdoctoral alumni home, and shared his understanding of academic research. Post doctors ought to add to the sum of human knowledge, and contribute to ideological resources and analysis framework. Wang said that, under the hope and support of all sectors of society, the center would carry forward the cause and make more brilliant achievements.


After the keynote speeches, the opening ceremony had a special session. The session was specially added under the requirements of postdoctoral alumni. Dr. Han Xiutao, the secretary general of All China Lawyers Association, presided over the session. Han recalled his academic experience with his tutor during his research in the center. Subsequently, eleven postdoctoral representatives presented flowers to the tutors, as an expression of gratitude.



All participants were photographed on the north side of the Century Hall. After that, the seminar came to the keynote speech session. Professor Zhang Xiang, vice dean of Renmin Law School, chaired the session. Professor Guo Honglin, the assistant to the president and division chief of the personnel department of RUC, Professor Ye Qiuhua, the former party secretary and vice dean of Renmin Law School, and Professor Zhu Guohua from Tongji University made keynote speeches about the ¡°retrospect and prospect of the training of law post doctors¡±.

Professor Guo Honglin introduced the basic situation of 19 post doctoral research centers of RUC. He also pointed out that in 19 postdoctoral centers, the center for law post doctors had the most distinctive characteristics, which was the oldest, largest, strongest, and had most extensive cooperation.


Professor Ye Qiuhua made a keynote speech on ¡°the Establishment and Early Development of t Center for Legal Post Doctoral Studies¡±. She pointed out that, the reason why Renmin Law School was the first law school approved to establish such a postdoctoral center was that it had a number of the country¡¯s most outstanding legal scholars and a full range of legal disciplines. Its rich academic resources and academic conditions showed that it was in the leading position in China¡¯s law education. It was precisely because of these unique advantages, China¡¯s first legal post doctoral center can be established in Renmin Law School.


Professor Zhu Guohua recalled his academic experience in the center. Focusing on the post doctoral system and the development of the rule of law in China, he pointed out that the post doctor center with interdisciplinary, cross regional and multi-language characteristics would inevitably promote the development of the rule of law in China in a special way.


Professor Zhang Zhihui, the director of the Procuratorial Theory Institute of the Supreme People¡¯s Procuratorate, Professor Shi Shaoxia, the dean and the former party secretary of National Procurator¡¯s College, made comments.



After the opening ceremony and keynote speech, the seminar entered the first session: ¡°the Theoretical Logic of the Rule of Law in China¡±. This session was chaired by Guo Weihua, the postdoctoral researcher of the center and the legal affairs director of China Huarong Asset Management Co., Ltd.

Professor Cao Gang from School of Philosophy, RUC, made a keynote speech on ¡°the Three Ethical Dimensions of the Rule of Law¡±.

Professor Fan Jinxue from School of Law, Jiao Tong University, made a speech entitled ¡°Rule of Law in China: World Significance and Theoretical Logic¡±.

Professor Yuan Dasong from School of Law, Beijing Normal University made a speech entitled ¡°Community of Destiny and the Rule of Law¡±.

Professor Shangguan Piliang, Kenneth Wang School of Law, Soochow University, made a speech. He said that the key of the rule of law in China was ruling the country according to the Constitution.

Professor Feng Xiaoqing from China University of Political Science and Law and Professor Hu Ming from Zhejiang University made comments.


The subject of the second session of the seminar was ¡°the Rule of Law in China: its Judicial Practice¡±. Professor Yu Yuhe from Nankai University chaired the session.


Professor Tang Weijian of Renmin Law School made a speech on ¡°Several Issues Concerning the Reform of China¡¯s Civil Execution System¡±. He pointed out that the core of judicial reform was the reform of the execution, and the core of the execution reform was the reform of the execution system.

Professor Cui Yongdong from East China University of Political Science and Law delivered a speech entitled ¡°Theory and Practice of Judicial Reform¡±.

The third speaker of the session was Sun Hailong, the President of the Fourth Intermediate People¡¯s Court of Chongqing. His speech was entitled ¡°Judicial Reform and Public Trust¡±.

The last speaker of the session was Guo Bing, the prosecutor of the Supreme People¡¯s Procuratorate. She made a speech entitled ¡°Sunshine plus Technology: the Practical Booster for the Rule of Law in China¡±.

Professor Deng Jianzhong from Nanchang University and Professor Nanjie Longyingqiang from Jiangsu Normal University made comments.


Seminar¡¯s third session was ¡°Social Development and Future of the Rule of Law¡±. Lu Zhiyong, chairman of International Auction Co. of China, Associate Professor Zhang Jiyu, who was dean assistant of Renmin Law School and executive dean of Rule of Law Research Institute in the Future, jointly presided over the session.

The first speaker was Professor Wang Wenhua, vice dean of Beijing Foreign Studies University Law School. Combining with the current trend of the Internet, she discussed the future development of criminal law in China from the perspective of cyber crime and cyber criminal law.

Associate Professor Du Hui from Chongqing University Law School made a speech on the subject of ¡°Environmental Law Codification and Systematic Environmental Law¡±. He said that the codification of environmental law faced with many problems: could environmental law be codified and to what extent? What were the core relationships to be dealt with in the codification? Du discussed these problems from two perspectives: ¡°inner function¡± and ¡°external form¡±.

The third speaker was Xu Ke, a post doctor of Renmin Law School. His topic was ¡°Intelligent Technology and the Rule of Law in the Future¡±. Intelligent technology¡¯s influence on the future rule of law was huge. It was likely to affect the status of the judiciary, bring controversy on the significance of making codes, change the objective conditions in promoting knowledge of laws and cause some changes of the legal occupation. Intelligent technology would not only help legal research, but also bring challenges.

Assistant Professor Feng Jian from Peking University Law School made a speech on ¡°the Future of Legal Commentary in China¡±. He pointed out that the legal commentary played an important role in the legal education and legal practice in Germany, and many scholars in China had tried it. As for the reasons, except the influence of the civil law system, it was also a try to conform to the current trend from ¡°legislation¡± to ¡°interpretation¡±. In addition, the factor that publishers pursued business opportunities was also included. There were two main factors in the future of legal commentary in China, namely, human factors and technologic factors.

Associate Professor Tu Yongqian from Renmin University of China School of Labor and Human Resources and Assistant Professor Lu Nan from Tsinghua University School of Law made comments on the speeches.


The closing ceremony was chaired by Professor Wang Yong, who was also the director of Law and Politics Department of the Party School of the Central Committee of CPC. Han Xiutao, Secretary General of All China Lawyers Association, made a conclusive speech. Han spoke highly of the seminar. He pointed out that the seminar saw a consensus reached among scholars, which was that today¡¯s rule of law had entered such an all-round and whole-process era. China¡¯s rule of law faced with three challenges: theory, practice and skill. It had reached the stage of strengthening the systematic construction.

Professor Wang Xu, who was the dean assistant of Renmin Law School, expressed gratitude to the center for the cultivation in his closing speech. He said that the theme of the seminar was quite large, and at the same time appropriate. In an era of drastic changes, the proposition of ¡°rule of law in China¡± directly served the needs of a great power, the context of which was quite different from when discussed ¡°the rise of a great power¡±. Guests showed the different sides of the theoretical logic from different perspectives: the seminar fully demonstrated the dimension of historical reason; the discussions showed the complexity of practical reason; at the same time, the seminar also adhered to the ¡°people-oriented¡± value rationality and a complex reflective rationality.


At the end of the seminar, Professor Lin Jia expressed sincere gratitude to all attendees. Lin pointed out that the development of Renmin Law School was inseparable from the efforts of teachers and students, and she expected that post doctoral alumni continuously paid attention to its development.


Seminar on ¡°Rule of Law in China: its Theoretical Logic and Practical Value¡± and the 25th anniversary of the Center for Legal Post Doctoral Studies fell its curtain. Participants had an in-depth discussion on legal issues in the process of building rule of law in China, and looked forward to the trend of rule of law concerning the rapid development of science and technology.
