The Annual Meeting of the Research Base for Theories of Environmental Justice of Renmin Law School was Successfully Held

On September 28th, 2018, the annual meeting of the Research Base for Theories of Environmental Justice of Renmin Law School was successfully held in Renmin University of China. This years meeting was hosted by Renmin Law School and co-organized by Foundation of Research and Education of Peng Zhens Thoughts on Democracy and Legal Systems, Institute of Green Development Strategies of China University of Political Science and Law, China Biodiversity Conservation and Green Development Foundation, and Beijing Zhonglun Law Firm.

Coming from Environmental Resources Tribunal of the Supreme Peoples Court, Environmental Resources Tribunal of Beijing No. 4 Intermediate Peoples Court, China Biodiversity Conservation and Green Development Foundation, Foundation of Research and Education of Peng Zhens Thoughts on Democracy and Legal Systems, Renmin University of China, Capital University of Economics and Business, Institute of Green Development Strategies of China University of Political Science and Law, Beijing Forestry University, Shandong Jianzhu University, Beijing Research Society of Environmental Legal System, Beijing Zhonglun Law Firm, Institute of Law of Chinese Academy of Social Sciences, and Beijing No. 2 Intermediate Peoples Court, more than 20 experts and scholars in fields of theory and practice attended the meeting. This meeting was centered on improvements in efficiencies of environmental judicial trials, assumption of responsibilities of environmental litigation and other crucial issues.

  Lin Jia, party secretary and associate dean of Renmin Law School delivered a welcome speech on behalf of the host school. Liu Xiaofei, presiding judge of Environmental Resources Tribunal of the Supreme Peoples Court also made a speech. Liu Na,secretary-general of Foundation of Research and Education of Peng Zhens Thoughts on Democracy and Legal Systems, Hou Jiaru, professor of Institute of Green Development Strategies of China University of Political Science and Law, and Wang Wenyong, lawyer from China Biodiversity Conservation and Green Development Foundation gave a speech as co-organizers.

Secretary Lin Jia pointed out that General Secretary Xi further clarified the importance of environment in the report ofthe 19th Congress of the Communist Party of China, and that environmental rule of law in China is steadily progressing. Recent weather data has witnessed a gradual decrease of the number of polluted days in Beijing. Deeper research into the theories of environmental justice has been increasingly important with the countrys emphasis on a Beautiful China and peoples yearning for pleasant environment. Secretary Lin hoped that the discussion surrounding these topics would provoke thoughts on solving problems of environmental justice in New Era, and she also expressed her sincere thanks for the support of the Supreme Peoples Court as well as other co-organizers and presence of all guests on behalf of Renmin Law School.

  Presiding Judge Liu Xiaofei highlighted that the Research Base for Theories of Environmental Justice has offered precious theoretical support for drafting judicial interpretations on public interest litigation and that it has made great contributions to environmental justice in China as well. She pointed out that achievements obtained in environmental justice have also coincided with challenges and she hoped that research results of this meeting could be applied in daily cases in near future.

  The first unit of the meeting was hosted by Prof. Zhu Xiao from Renmin Law School. Prof. Zhou Ke, director of the research base, first expressed his thanks for the attendees and introduced some basic information about the base. Prof. Zhou then delivered his report on last years work of the base, which featured five parts, including perfecting basic regulations, cementing organizational discipline and performing assigned tasks well, extending academic influence, improving teaching and research levels, and problems to be addressed as well as the schedule for the following year.

Ma Jun, presiding judge of the Environmental Resources Tribunal of Beijing No. 4 Intermediate Peoples Court made a speech on claim, assumption of responsibility, responsibility to prevent and act preservation system in the realm of environmental litigation. Director Yang Jun from Beijing Dongze Law Firm offered advice on issues regarding differences of entities, calculation of ecological restoration costs and judicial interpretations on sea waters. Prof. Zhu Xiao expressed his opinion on the system of expert assessor. Attorney Wang Wenyong from China Biodiversity Conservation and Green Development Foundation presented his viewpoints concerning existent problems in environmental public interest litigation. Prof. Gao Guilin from the Law School of Capital University of Economics and Business discussed procuratorates support for civil public interest litigations in environment.

The second unit of the meeting was hosted by Liu Na, secretary-general of Foundation of Research and Education of Peng Zhens Thoughts on Democracy and Legal Systems. Prof. Hou Jiaru from Institute of Green Development Strategies of China University of Political Science stressed that the trial of lawsuits related to environmental damage compensation could learn from bankruptcy proceedings. Prof. Yang Zhaoxia from Beijing Forestry University delivered a speech entitled To Indirectly Protect Relics: Musts and Must-nots of Environmental Law. Prof. Liu Guotao from Shandong Jianzhu University offered his opinion on countryside environmental conservation. Associate Prof. Tan Baiping from Beijing University of Technology presented his views based onthe environmental public interest litigation lawsuit in Xinzheng, Henan Province.

The third unit was hosted by Prof. Liu Guotao. Dr. Lin Xiaoxiao from Institute of Law of Chinese Academy of Social Sciences presented a speech focusing on the alteration of environmental pollution responsibility in the draft of tort law of the forthcoming Civil Code. Attorney Yu Luping from Beijing Zhonglun Law Firm shared his thoughts regarding prosecutors and ways of environmental administrative public interest litigation. Dr. Jin Ming from Beijing No. 2 Intermediate Peoples Court delivered a speech on the judicial linkage system of environmental civil public interest litigation.

Lastly, Prof. Zhou Ke gave his concluding remarks. He pointed out that this years meeting was youthful, efficient and challenging. He encouraged the attendees to stick firmly to the original goal of the research base, remain aware of the responsibility it shouldered as the first one ever established in the field of environmental justice in the country and create its value by exploring and advancing both in practice and teaching. The 2018 annual meeting of the Research Base for Theories of Environmental Justice of Renmin Law School came to a successful end!
