The 9th Cross-strait Master-Doctor forum on civil and commercial law of Hong Kong and Macao was successfully held


On 14 October 2018, the 9th Cross-strait Master-Doctor forum on civil and commercial law of Hong Kong and Macao was successfully held in the Law School of Fujian Normal University. The theme of the forum were Property Volume and Personality Rights Volume of Civil Code. The seminar was hosted by Renmin University of China civil and Commercial Law Research Center,organized by the Law School of Fujian Normal University. Juris Doctors and Masters majored in civil and commercial law from Renmin University and other famous universities attended the forum.


     The opening ceremony was presided over by Li Feng, secretary of the Party committee of the law school of Fujian Normal University. Prof. Lin Xuxia,president of the law school of Fujian Normal University, Prof. Yang Lixin,director of Renmin University of China civil and Commercial Law Research Center, and Prof. Guo Dawei from Fu Jen University of Taiwan respectively delivered their speech. An awarding ceremony was held on the opening ceremony--- the 10th Jianjiao Award for excellent research results of Masters majored in Civil and Commercial Law. Zhang Pan, Qu Zibin and Xu Yinbiao won the awards and were awarded by Prof. Yang Lixin.


    There were two different sections in the forum, one on Property Volume and the otheron Personality Rights Volume. 38 researchers shared their own academic achievements on the legislation, theory and practice of Property Volume and Personality Rights Volume. They also communicated their experience of researching and established friendships between each other.

Section one: Personality Rights Volume ofCivil Code

     The first unit was presided over by Yan Youhong, Assistant Professor from Taiwan University. Gao Xuejuan, a JD from FJNU made a report on the legalregulation of doctor-patient complicit of rights due to the use of electronicmedical record. Lv Zongye, a LLM from Taiwan University, made a report onthe protection of pets’ owners’ personality rights. Wangwei, also from Taiwan University , shared his essay on Commercial utilization of personality traits. Doctor Wang Yichun from CUFE commented on these three essays.

    The second unit was also presided over by Mr. Yan. Wang Xing, a JD from University of Macau, and Zhao Dan, a LLM from the same school, respectively shared theiressays. Luo Dawei and Du Junyan, also shared their academic achievements. Theiressays were then commented by Doctor Wang Yichun from CUFE Law School.

The third unit was presided over by Associate Professor Zheng Renrong from FJNU LawSchool. Hu Yan, a JD from Renmin Law School, made a report on Study on compensation system for mental impairment. Tong Lu, a LLM from FJNU law school,made a report on Personal information disclosure. Lin Yanchen from Taiwan University, made a report on The statute of limitations on compensation for personal rights damages caused by default. Su Jingxia, a JD from Fu Jen University of Taiwan, also shared his latest research on The identification of food consumption damage. Jia Siyin from FJNU Law School,also shared her academic achievements. Prof. Wei Shufa from FJNU Law School commented on their essays.

     The fourth part was also hosted by Doctor Wang Yichun from CUFE Law School. QuZiin, JD from Renmin Law School, made a report on The judicial recognitionof commercial defamation. Chen Xinghong from Fu Jen University of Taiwan made a thesis report on Legal evolution and judicial practice of civilpunishment. Li Siyi, JD from CUHK made a report on Unjust enrichment system from the perspective of civil code compilation. Prof. Wei Shufa fromFJNU Law School made brief comments on their reports.

Section two: Property Volume of Civil Code

     The first unit was presided over by Shui Bing, Associate Professor from University ofMacau. Liu Jing, a JD from law school of Peking University, made a thesis report on Reasonable limitation on the validity of floating mortgage inChina --- a research from the angle of guarantee system of purchase price in USA. Yang Liu, a LLM from the Law School of Jilin University, made a reporton new-type rights financing guarantee. Kang Peng, a LLM from the Law School of Wuhan University, made a thesis report on standard selection of mortgage transfer under the principle of fairness. Guo Dawei, Vice President of Fu Jen Law School of Taiwan, made comments on their essays. Prof.Wu Congzhou from Taiwan University voiced his opinions on their essays.

     The second unit was also hosted by associate professor Shui Bing. Chen Zhirui, a JDfrom the Law School of Taiwan University, made a thesis report on the usagerights of Aboriginal Reserve and numerus clausus. Zhou Chongcong, a LLMfrom South China Normal University, made a report on reformation ofmortgage on the ownership of the contracted farming landin the Property Volume. Zhen Yuqian, Li Wenhua, two LLMs from the law school ofFujian Normal University, made their reports respectively. Associate Professor Zhang Dongmei from law school of Fujian Normal University made comments on these four essays.

     Prof. Zhang Lin from law school of Fujian Normal University presided over the third unit. Gao Haining, a JD from FJNU law school, shared his thesis report on the perfection of Usufructuary right collection in PropertyVolume. Shang Zhenru, a JD from Macau Law School, made a thesis report on Exclusiveuse of public property and Macao sea area. Cai Ruixin and Liu Yangyang, two LLMs from Sichuan University and Shanghai foreign economic and trade university, also shared their own academic achievements. Associate Professor Shi Zhiyuan from FJNU law school made comments on their essays.

     The fourth unit was also hosted by Prof. Zhang Lin from FJNU law school. Liu Weiwei from Heilongjiang University made a report about E-commerce Law. Jiang Deting,a LLM from Taiwan University made a thesis exercise of jointcredits. Guo Hongchen from BJNU made a report on Study of accession system.Prof. Wu Congzhou from Taiwan University commented on their essays.


   Theclosing ceremony was held by Lin Xuxia, president of FJNU Law School. Prof.Yang Lixin, director of Renmin University of China civil and Commercial LawResearch Center, Prof. Wu Congzhou from Taiwan University and Yang Yinhong,vice president of FJNU Law School, delivered their speeches respectively. They expressed their sincere gratitude to attending guests and conference personnel. They also thanked everyonefor their support to the work of Renmin University of China civil andCommercial Law Research Center and FJNU Law School. The seminar wassuccessfully concluded with warm applause.
