Forum of China Legal Governance of Food Safety was held in Beijing: the Discussion about the Legal Governance of Food Safety

  On 28, October, 2018, the forum of China Legal Governance of Food Safety (2018) was held in the Century Hall of Renmin University of China (RUC). Hosted by Center for Coordination and Innovation for Food Safety Governance of RUC and China Law Society Food Safety Law Research Center, the forum was jointly organized by China Health Media Group (CHMG) and China Cuisine Association (CCA) and presided over by Wang Xu, the professor of the law school of RUC. The directors and experts from State Admission for Market Regulation, the Supreme People's Procuratorate of the People's Republic of China, Local Departments of Food Safety Supervision, the judicial authority, institutions of higher learning and research institutes and various enterprises, consisting of almost 150 people, attended the forum.

  Presided over by Wang Weiguo, the director of China Law Society Food Safety Law Research Center, the opening ceremony of forum started with the title of "The past decade of China Legal Governance of Food Safety: 2008-2018". After reviewing the achievements made during the past ten years from more than ten dimensions, including the location, principle, horizon and innovation, in the form of video, the forum then expressed sincere expectations to the future.

  On behalf of RUC, Prof. Zheng Shuiquan, the deputy Party secretary of RUC, asserted that the cooperation of the academic circles, supervision departments, food industries and enterprises was greatly conducive to exploring the theory about legal governance of food safety and enhancing multiple subjects' governing ability, since it was an essential part of the social co-governance. The forum aggregated the experts from different aspects to discuss the problems including legal system innovation and industry compliance construction appeared in the development of legal governance of food safety, which was absolutely significant to boost the combination of theory study and supervising practice.

  Prof. Han Dayuan, the director of Center for Coordination and Innovation for Food Safety Governance of RUC, and Xu Donglei, the director of CHMG, gave a brief speech respectively on behalf of the sponsor and the co-organizer.
  Having showed sincere gratitude to all the attendees, Prof. Han emphasized that food safety had been an inevitable problem to all over the world. Guaranteeing people¡¯s health and food safety had become the most core principle of Healthy China, and it also should be the starting point and highest rule of all legal systems concerning food safety. In light of laws undoubtedly had fundamental, sound and stable functions during the governance of food safety, it was advisable to enhance the scientific legislation and democratic legislation of food safety and pay more attention to the relevant legal enforcement.

  The director Xu analyzed the new challenges appeared after catering service entered the Internet era. He pointed out that the essence of food safety problems was social problems. In order to create the ideal situation such as "eating without worry, living without disease", the social co-governance in which many aspects including the government and enterprises participated should form as soon as possible. He suggested that the supervision departments could support the platform to clarify the food safety standard that small-scale commercial tenants should comply with and the government should promulgate relative policies to motivate and publicize the platform market, which would help to set good examples of small-scale chain catering enterprises.

  The forum consisted of three parts: the keynote speeches, the seminar and the round table conference.

  The keynote speeches focused on the newest situations of food safety legal system. Chen Xu, the inspector of food operation supervision department of State Admission for Market Regulation, introduced the latest development in the construction of China Internet food safety legal system. He pointed out that because the Internet food operation was a new business, China, as the first country that defining the third-party platform's obligation and legal responsibility in the Internet food transaction in the world, specifically formulated the rules to regulate and supervise the illegal behavior about Internet food safety and gave the "Chinese Voice" to the global governance of Internet food.

  With the topic of the developing direction of China food safety legal governance, Ren Duanping, the vice director of the law department of State Admission for Market Regulation, shared his thought about the legal construction under the background of market supervision system reform. He claimed that considering the reform background, we should finish following tasks: further improving the legislative system and procedure and enhance the scientific legislation; spurring the basic laws such as the Constitution, the Criminal law, the Civil law and the Administrative law to support the supervision more effectively in order to strengthen the comprehensive guarantee of food safety; maintaining the food safety science legal order based on the analysis of typical cases and problems; solving the sophisticated contradictions that restricted the development of food governance.

  In terms of the current situation and characteristics of catering service, Feng Enyuan, the vice director of CCA, introduced the problems of legal guarantee mechanism in food industry. Then, Wang Haibo, the vice director of the early warning communication and standard office of food sampling department of State Admission for Market Regulation, shared the national sampling results. Ding Dong, the senior researcher of institute of legal policy of Meituan-Dianping, analyzed the recent situation of local small-scale catering business legislation and supervision. Sun Juanjuan, the researcher of Center for Coordination and Innovation for Food Safety Governance of RUC talked about her thought about the future of food safety governance.


  Then, LU Lei, the director of solicited articles review committee office, declared 20 prize-winners, which included the director of the research office of Zhongshan second people's court of Guangdong province Li Shiyin. Prof. Zheng Shuiquan, the inspector Chen Xu, Prof. Han Dayuan issued winners with certificates.

  The seminar could be divided into three sections. The first section focused on "the Chinese wisdom and local experience of catering service legal governance" and was hosted by Liu Zhiyong, the director of the MPA education center of Capital University of Economics and Business. Fu Weihua, the chief of law department of Shanghai Municipal Food and Drug Administration (FDA), Ruan Yingxiao, the principal staff member of law department of Zhejiang province FDA, Yan Jinlin, the head of food production supervision department of Huzhou Municipal Admission for Market Regulation of Zhejiang province, Zhang Weiwei, the chief of inspection bureau of Foshan Municipal FDA of Guangdong province and Tang Boxing, the director of regulation department of Taizhou Municipal FDA of Jiangsu province shared their opinions respectively.

  The second section mainly discussed about "the legal compliance challenges and response in catering service", which was presided over by the researcher Lu Lei. Lu Weifu, the director of law department of Anhui province FDA, Li Mingyang, the principal staff member of law department of Beijing Municipal FDA, Li Haipeng, the founder of "Panda Selected", Liu Jinrui, the researcher of China Law Society Food Safety Law Research Center and Song Yahui, the associate professor of the law school of Nanjing University exchanged their ideas.

  The third section was around the topic "the practical observation of catering service legal governance", which was hosted by Gong Gangqiang, the vice dean of college of humanities and law of Beijing University of Agriculture, Xiao Pinghui, the associate professor of the law school of Guangzhou University, Wang Guangping, the researcher of Shanghai Municipal Food and Drug Research Center and Ding Daoqin, the chief of institute of legal policy of JD.COM joined the discussion.

  During the round table conference, the representatives from supervision departments, enterprises, institutions of higher learning and research institutes communicated with each other in the aspects of the high-quality development of catering service and the optimization of legal guarantee system. They concluded that we should not only analyze the whole catering service structure characteristics objectively, but make a record for the catering business, in order to improve the quality of online and offline services.

  When it came to the ending ceremony, Prof. Hu Jinguang, the director of the management committee of Center for Coordination and Innovation for Food Safety Governance of RUC, summarized that enhancing the food safety legal guarantee was a crucial way to protect "the safety of every bite of food" and it still had a long way.

  The forum ended in warm applause. This forum was a typical and meaningful demonstration of implementing social co-governance in the field of food safety, which was extremely significant to the specific practice of improving the industry standard and enhancing the cooperation of online and offline catering business.
