The Third Seminar on the Civil Code of China and France was successfully held

    On November 28, 2018, the Third Seminar onthe Civil Code of China and France was successfully held in Law School ofRenmin University of China. The seminar was sponsored by the CivilJurisprudence Research Society of China Law Society, the Research Center ofCivil and Commercial Jurisprudence of Renmin University of China and the LawResearch Center of French-speaking Countries. It was co-sponsored by the LegalDepartment of the French Embassy in China, the French Continental LawFoundation and the Beijing Zhonglun Law Firm.

    More than 120 experts from more than 80national and international institutions, including the Law Committee ofNational People,s Congress, the Supreme Court, Renmin University of China, PekingUniversity, Tsinghua University, China University of Political Science and Law,National Judge College, Central University of Finance and Economics, FudanUniversity, Wuhan University, University Paris 2, University of Montpellier,University of Geneva participated in the meeting. Based on practice and theory,the participants of seminar contributed brilliant academic innovations to therelevant issues of the Civil Code, and provided very useful ideologicalresources and theoretical support for the next compilation of the Civil Code.

    The opening ceremonywas presided over by Professor Yao Hui, Director of the Research Center ofCivil and Commercial Jurisprudence of Renmin University. Professor Wang Liming,Executive Vice President of Renmin University of China and President of CivilJurisprudence Research Society of China Law Society, delivered a speech onbehalf of the sponsors. He pointed out that over the years, China and Francehave had fruitful exchanges and interactions in the field of civil law, andhave organized in-depth exchanges in the fields of guarantee law, tort law andcontract law. This seminar was held at a very critical stage in the compilationof China,s civil code, which is of great significance. France has been engagedin major reforms of contract law and tort law in recent years can provideuseful reference for the compilation of the Chinese Code.

    This seminar is composed of fivemodules:" Right of Personality", "General Provisions of Contract","Contract", "Tort Liability I" and "Tort LiabilityII".

    The closing ceremony of the seminar washosted by Professor Shi Jiayou, executive director of the Research Center ofCivil and Commercial Jurisprudence of Renmin University. Professor Michel Grimaldi,prominent French scholars, senior professor of the University Paris 2, andchairman of the Academic Council of the Continental Law Foundation, and DeanWang Yi made concluding remarks separately. Professor Michel Grimaldi said thatthe topics of the seminar were comprehensive, ranging from macro-level researchto microscopic analysis, and that many of the issues discussed might be moretraditional civil law issues, as well as many issues that were very close totoday,s social life, such as electronic contracts, autonomous driving,ecological damage, medical liability and so on. On some issues, there aredifferences in the legal system between China and France. However, the CivilCode must reflect the life and reality of the people, therefore, the differencesbetween national conditions and culture will certainly be reflected in theCivil Code. However, there is more in common between China and France, forexample, both emphasize the clarity and predictability of legal rules, whichare extremely precious common values in the legal culture of the two countries.

    In the summary, President Wang Yi pointedout that the long-standing cultural exchanges between China and France haveplayed an important role in mutual inspiration and reference. Today, when thecompilation of China,s Civil Code has entered a critical stage, such a high-endacademic seminar is also intended to carry out the culture of the two countriesin the field of law. We should seek inspiration and reference from each otherthrough in-depth interaction. In 1804, the French people had a civil code thatthey are proud of even now. The Chinese people especially hope that when theNational People,s Congress and the Chinese People,s Political ConsultativeConference conclude in March 2020, a Chinese civil code will be produced,making all Chinese proud. This great goal deserves our unremitting efforts andstruggle. Finally, the seminar ended satisfactorily with warm applause from theparticipants.
